Terms of Service
Standard terms and conditions governing the supply of metallurgical components, wear parts, and engineering services by PyroForge.
01 Scope of Application
These Terms and Conditions apply to all contracts, deliveries, and other services provided by PyroForge ("Supplier") regarding the sale of heat-resistant castings, grate bars, side plates, and related metallurgical spare parts.
Any deviating conditions of the Purchaser shall not apply unless explicitly confirmed by the Supplier in writing. Acceptance of delivered goods shall be deemed as acknowledgement of these conditions.
02 Technical Specifications & Tolerances
Unless otherwise agreed, all chemical compositions and mechanical properties are based on standard industrial norms (DIN 1.4823, ASTM A297, or equivalent).
- Dimensional Tolerances: Castings are subject to standard shrinkage tolerances (VDG P690 or ISO 8062) unless precision machining is specified in the quote.
- Material Analysis: Certificates of chemical analysis (Spectrometer report) accompany all shipments. Minor deviations within standard permissible ranges shall not constitute a defect.
- Surface Finish: Cast surfaces are supplied "as cast" unless shot-blasting or machining is explicitly detailed in the purchase order.
03 Warranty & Inspection
Notice: Due to the extreme operating conditions (up to 1250°C) of pellet induration machines, service life warranties are conditional upon maintaining specified thermal ramp-up rates and cooling cycles.
The Purchaser must inspect goods immediately upon receipt. Claims for visible defects (porosity, cracks, dimensional errors) must be made in writing within 10 days of delivery.
Latent defects related to metallurgy (e.g., internal structural failure) are warranted for a period of 12 months from delivery or 6 months from installation, whichever comes first. Warranty is limited to the replacement of the defective part ex-works.
04 Limitation of Liability
To the extent permitted by law, PyroForge shall not be liable for:
- Production downtime or kiln stoppage
- Loss of profit or revenue
- Costs of installation/removal
- Damage to ancillary equipment
The Supplier's total liability for any claim shall strictly not exceed the purchase price of the specific defective component.
05 Intellectual Property & Patterns
Molds, patterns, and casting tools manufactured by PyroForge remain the property of PyroForge, even if a portion of the tooling cost was charged to the Purchaser, unless otherwise explicitly agreed in a separate Tooling Transfer Agreement.
Technical drawings provided by the Purchaser for custom fabrication will be treated confidentially. The Purchaser warrants that such drawings do not infringe on third-party IP rights.
